Aye, what they are saying is that Klingon is now a real life language, therefore according to them it follows that you can't copyright it (note the "apparently" in my original post ). Now whether, as you say, the court backs it up we won't know until... 2017?

It honestly doesn't matter if Klingon goes one way or another -- they have enough other IP that they can let Klingon go. When I was a wedding videographer I filmed a Klingon wedding in Klingon, so I saw it as a "real life language" with people using it in a real-life setting.
On the other hand, maybe I should start making costumes and gathering actors to make money off Trek if Axanar wins lololololol
